By submitting your personal or business information through this signup form, you acknowledge and agree to the following terms, which govern how TrustLinq CH AG collects, processes, and protects your data in accordance with Swiss law and the standards of the Supervisory Organization for Financial Intermediaries & Trustees (SO-FIT).

Purpose of Collection

The information you provide, whether as an individual or as a representative of a company, is collected for the purpose of establishing and maintaining a contractual or pre-contractual relationship with TrustLinq. This includes:

  • Fulfilling identification and verification obligations under the Swiss Anti-Money Laundering Act (AMLA) and SO-FIT regulatory requirements
  • Performing risk assessments
  • Conducting ongoing monitoring and transaction screening
  • Ensuring compliance with applicable financial regulations
  • Facilitating communication related to onboarding, verification, and service provision

Legal Basis for Processing

Processing of personal and company data is carried out under Articles 31 et seq. of the Swiss Federal Act on Data Protection (FADP 2023), Articles 3 et seq. of the Swiss Anti-Money Laundering Act (AMLA), and the SO-FIT Self-Regulatory Rules applicable to TrustLinq CH AG. The legal basis for processing may include:

  • The necessity to comply with legal obligations
  • The performance of a contract or pre-contractual measures
  • Your explicit consent to the processing of data submitted through this form

Data Sharing and Transfers

In fulfilling its regulatory and operational duties, TrustLinq CH AG may share personal and company information, including data relating to beneficial owners and authorized representatives, with:

  • Regulated compliance partners
  • Third-party verification systems
  • Banking and payment partners
  • Authorities where disclosure is legally required

Data may also be transferred to service providers located within Switzerland, the European Economic Area, or other jurisdictions recognized by the Swiss Federal Council as providing adequate data protection. In all cases, TrustLinq ensures that such third parties operate under legally binding agreements that guarantee confidentiality, integrity, and data security in accordance with Swiss standards.

Data Retention

All information collected during the onboarding and account relationship process is retained for as long as necessary to meet statutory obligations under Swiss AML and commercial law. In general, this period extends for ten (10) years following the termination of the business relationship or the completion of the last transaction, unless a longer retention period is required by law or regulatory guidance.

Your Rights

Under the Federal Act on Data Protection, you have the right to:

  • Request access to your personal data
  • Correct inaccurate or incomplete information
  • Request the restriction or deletion of processing (where legally permissible)

Any such requests may be directed to [email protected]. Please note that deletion or restriction requests cannot override mandatory retention periods required under AMLA or other applicable legislation.
